On October 22 2009, I parked in a handicapped space while visting a friend. A parking citation was issued to the registered owner of the vehicle (which is in my company name).
Everything in life is nothing more than simple contract, including parking citations, traffic tickets etc. These offers to contract can be 'Conditionally Accepted' where the terms are changed to more favorable terms as can be seen in this example.
If just 10% of the citations issued resulted in a conditional acceptance being returned, police and cities would be more careful about the citations issued due to the financial risk. This is a strategy that demonstrates the power truly lies with the people to effect change in law enforcement. Conditional Acceptance of Offer -
A conditional acceptance offers a honorable way to accept responsibility for an infraction of a statute, but allows one to change the contract to more agreeable terms. A parking citation is an 'offer' to enforce the parking statute, for which I accepted this responsibility but changed the rules a little bit. The key to success in this conditional offer is that the City must demonstrate acceptance of my conditional offer by having the DMV collect the fine. Irvine Police Parking Notice 1 -
Very official looking document with all the red and black, hey look on the back there is even a place turn in the responsible party in the event it wasn't the registered owner who was responsible. Think about this for a moment, they offered to contract with a fiction, a corporation is just a piece of paper - also notice that the DUE DATE has changed from the due date on the citation, but there has been no response directed to the notary from the City of Irvine. This is just an attempt to get me to abandon my conditional offer and contract with them on their terms, this notice was ignored.
Irvine Police Parking Notice 2 -
This one is really funny to me. Apparenty there was an Administrative Review and the Outcome Upheld. At no time was an administrative review requested or even appropriate as I did not dispute if the citation was valid or not. I accepted the citation (yes the car was parked where the officer who wrote the citation said it was) and added my own conditions. The original Conditional Acceptance of Offer is in full agreement that the Evidence Submitted Does Not Prove That The Violation Did Not Occur. This is another desperate attempt to convince me to abandon my Conditional Acceptance and contract with them on this new worthless document, this notice was ignored.
DMV Registration Notice -
This is the notice I received from the DMV for the registration fees. Unfortunately, it appears that the City of Irvine decided they did not like the terms of my conditional offer, as of the latest update the City has not notified the DMV to collect the parking citation fees. I have used this same strategy to modify the terms of many parking citations, to date not one has been accepted. Some might say I have 'beat' these parking citations.
